Once your record is expunged, potential employers are prohibited from inquiring about the expunged convictions or arrests. Expungement may only be sought once, so it’s important to do it correctly. Generally, if a petition is denied by the court for any reason (including procedural reasons), it cannot be re-filed nor can a new petition be filed requesting the same criminal cases be expunged.

Expungement in Indiana also carries the benefit of restoration of civil rights, including the right to be deemed a “proper person” under Indiana firearms law—that is, a person that may lawfully possess a firearm. The only exception to this rule is for those who have been convicted of a crime of “domestic violence.” In such cases, a separate petition must be filed to request restoration of the right to possess a firearm.

Keep in mind, a successful expungement and/or restoration of rights does not always mean you will pass a National Instant Criminal Background Check System (“NICS”) inquiry through a firearms dealer. Often an additional application must be made to the FBI to clear your record in the NICS system. Our attorneys are experienced in also clearing these records.
